PlanetCrumbs.com, a platform dedicated to selling unique sculptures and art pieces crafted by CRUMBS. By accessing or using this website (the "Site"), you agree to comply with these Terms of Use and all applicable laws and regulations. If you do not agree with these Terms, you should not use the Site.

1. General Terms

These Terms of Use ("Terms") govern your use of PlanetCrumbs.com, including all pages, content, and services provided by PlanetCrumbs. These Terms constitute a binding agreement between you and CRUMBS. We reserve the right to modify or update these Terms at any time, and your continued use of the Site will signify your acceptance of any changes.

To use this website, you must be at least 18 years old or have the consent of a parent or guardian. By using the Site, you represent and warrant that you are of legal age to form a binding contract.

2.2 Account Creation (Upon Availability)
To make purchases or commission custom sculptures, you may be required to create an account on PlanetCrumbs.com. or email info@planetcrumbs.com. You agree to provide accurate and complete information when creating your account and to update it promptly if anything changes.

2.3 Restrictions on Use
You may use the Site solely for lawful purposes and in accordance with these Terms. You agree not to:

3. Products and Availability

The sculptures and art pieces available for sale on PlanetCrumbs.com are original works by CRUMBS. Each artwork is sold as a unique, one-of-a-kind piece or in limited editions. The availability of each piece is subject to prior sale and inventory.

3.2 Custom and Commission Work
We offer custom sculptures and commissions for clients seeking personalized artwork. These commissioned works are subject to availability and the terms of the individual commission agreement. Prices for custom sculptures will be provided on a case-by-case basis and must be agreed upon before production begins.

3.3 Product Descriptions
We strive to provide accurate descriptions of the sculptures and artwork available on the Site. However, we do not guarantee that the descriptions, images, or other content on the Site are free from errors. If a product is listed at an incorrect price or description, we reserve the right to cancel or modify your order.

3.4 Limited Editions and Availability
Some artworks may be limited editions. Once the edition is sold out, no further copies will be made unless otherwise specified. We do not guarantee the availability of any particular sculpture after it has been sold.

4. Ordering and Payment

4.1 Order Process
To place an order, you must complete the checkout process by providing accurate billing and shipping information. By submitting an order, you agree to purchase the selected sculpture at the specified price.

4.2 Payment Terms
We accept payment through Stripe, which securely processes payments. Payment must be made in full before the artwork is shipped. Prices for custom works are subject to prior agreement. Upon successful payment, you will receive an order confirmation email.

4.3 Taxes and Duties
Sales tax or VAT may apply depending on your location. You are responsible for any additional duties, taxes, or customs fees associated with international shipments.

4.4 Order Cancellation
Once your order is placed and payment is processed, it cannot be canceled or modified. Custom orders and commissions may only be canceled under the specific terms agreed upon before production.

5. Shipping and Delivery

5.1 Shipping
We will ship your purchased sculpture(s) as soon as possible after payment has been processed. Shipping fees will be calculated during checkout based on the delivery address. CRUMBS ships worldwide but delivery times may vary depending on the location.

5.2 Delivery Times
While we aim to deliver your sculpture promptly, delivery times may vary depending on the destination and shipping provider (A shipping window of 6 weeks) . Once your order has been shipped, you will receive a tracking number to monitor the status of your shipment.

5.3 Risk of Loss
The risk of loss or damage to the artwork is transferred to you upon delivery. We are not liable for any damage or loss that occurs during shipping once the sculpture has been handed over to the carrier.

5.4 International Shipping
If you are purchasing from outside your home country, you agree to comply with any applicable import/export regulations. You will be responsible for any customs duties, taxes, or fees for international shipping.

6. Returns and Refunds

6.1 Return Policy
All sales of sculptures are final. Due to the nature of the products (limited and one-of-a-kind art pieces), we do not accept returns or exchanges unless the artwork is delivered damaged or is not as described.

6.2 Refunds
If your sculpture arrives damaged, please notify us within [24] hours of receipt to initiate the return process. A refund will only be issued if the artwork is confirmed to be damaged during shipping, or if it significantly deviates from the description provided on the Site.

6.3 Damaged Artwork
If your artwork is damaged during transit, we will work with the shipping carrier to resolve the issue. Please document the damage with photos and notify us immediately.

7. Intellectual Property

7.1 Ownership of Content
All content on PlanetCrumbs.com, including sculptures, artwork, images, text, graphics, logos, and designs, is the property of CRUMBS or its content suppliers and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works of any content from the Site without explicit written permission.

7.2 Limited License
When you purchase a sculpture, you are granted a personal, non-transferable, and non-exclusive license to display the artwork. This license is for personal use only and does not grant you the right to reproduce, sell, or distribute the artwork in any form, including digital or physical formats.

7.3 Commissioned Work Ownership
For custom commissions, ownership of the final sculpture will be transferred to the buyer upon full payment. However, the artist (creationsofla) retains the right to use images of the commissioned work for portfolio, promotional, and marketing purposes.

8. User-Generated Content

8.1 Submissions
By submitting any content to PlanetCrumbs.com (e.g., reviews, photos, or comments), you grant us a perpetual, royalty-free, worldwide license to use, display, and modify such content for marketing, advertising, and promotional purposes.

8.2 Prohibited Content
You agree not to submit any content that:

Violates any law or regulation.
Is defamatory, offensive, or harmful.
Infringes upon the intellectual property rights of others.
Contains malware, viruses, or other harmful code.
